Privacy Policy

OVERVIEW

Gamma Allergy Australia regards customer privacy as an important part of our relationship with our merchants and partners. Gamma Allergy Australia is bound by the Privacy Act 1988 (as amended), the February 2018 amendments and the Australian Privacy Principles (collectively, Privacy Law). The following privacy policy applies to all Gamma Allergy Australia users, and sets out the way in which GAA collects and uses personal and corporate information, and other requirements as set out in the Privacy Law.

We consider your use of the service to be private. However, we may access or disclose information about you, your account and/or the content of your communications, in order to: (1) comply with the law or legal process served on us; (2) enforce and investigate potential violations of this contract; including use of this service to participate in, or facilitate, activities that violate the law; or (3) protect the rights, property, or safety of GAA, its employees, its customers or the public. You consent to the access and disclosures outlined in this section.

The service is a private computer network that GAA operates for the benefit of itself and its customers. GAA retains the right to block or otherwise prevent delivery of any type of email or other communication to or from the service as part of our efforts to protect the service, protect our customers, or to prevent breaching this contract.

In order to provide the service, we may collect certain information about service performance, your machine and your service use. We may automatically upload this information from your machine. This data will not personally identify you.

The service does not hold designated record sets as defined under the U.S. Health Insurance Portability and Accountability Act of 1996 and the regulations promulgated thereunder (HIPAA), nor medical records as defined under state law.

Our e-portal is hosted on Microsoft Inc. Azure cloud service. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Microsoft Inc. Azure cloud service data storage, databases and the general GAA application. Your data is stored on a secure server behind a firewall managed by GAA.

CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

PAYMENT

GAA takes your credit card data but does not store it. Credit card information attached to user accounts are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) and held by our payment service provider, eWay.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

COOKIES

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. You can remove persistent cookies by following directions provided in your Internet browser’s technical information. In general, we use the information that is collected through the use of cookies on our Site to make the Site more useful to you and to tailor your experience with us and our communications with you to meet your special interests and needs.

Some of the ways in which we use cookies may include the following:

  • When you register for GAA ePortal services, we use cookies to make it easier for you to
  • navigate through and complete the registration form.
  • When you login to GAA ePortal, we use cookies to easily authorise your credentials as you navigate through our secure pages.

If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as our administration area, may be limited.

COMMUNICATIONS

GAA uses your personal information for essential communications, such as confirmation Emails, accounts information, and critical service details. We may also use this information for other purposes, including direct marketing. If at any time you wish not to receive such correspondence, you may request to be removed from any mailing lists by emailing us at compliance@gammaallergy.com.au.

THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies, so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently.

Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
